Indigenous peoples have rights that are protected under Section 35 of the Constitution Act, 1982.

“The existing aboriginal and treaty rights of the aboriginal peoples of Canada are hereby recognized and affirmed.”

The full scope of Section 35 rights are not recognized by Canada.
